Cocaine Charges Are On The Rise In Holmdel NJ

There is little doubt that drug charges involving cocaine are on the rise and even in affluent municipalities like Holmdel. The police routinely encounter this controlled dangerous substance (“CDS”). Just the other day, police witnessed a bag of cocaine poking out of the pocket of a motorist stopped for speeding. An ensuing search revealed not only the presence of cocaine but also Xanax and Oxycodone. The illegal possession of these drugs resulted in issuance of multiple criminal offenses.

Possession of cocaine in a situation like this typically results in a third degree crime. The same is true for the Xanax and Oxycodone as a valid prescription was not possessed by this defendant. All indictable crimes like these must be sent to the Monmouth County Superior Court for handling. In accordance with N.J.S.A. 2C:35-10, third degree possession of drugs like these carry the potential for a fine of up to $35,000 and a maximum prison sentence of five years. A conviction for this type of offense also results in a driver’s license suspension of six to twenty-four months.
