Possession of cocaine in a situation like this typically results in a third degree crime. The same is true for the Xanax and Oxycodone as a valid prescription was not possessed by this defendant. All indictable crimes like these must be sent to the Monmouth County Superior Court for handling. In accordance with N.J.S.A. 2C:35-10, third degree possession of drugs like these carry the potential for a fine of up to $35,000 and a maximum prison sentence of five years. A conviction for this type of offense also results in a driver’s license suspension of six to twenty-four months.
